1. Scope
HighwayTMS is a business tool. Customers upload documents (for example BOLs, PODs, rate confirmations, and driver credential files) and company logos, which we store in private, access-controlled storage. Content is not published to the public. This policy explains how we respond to notices of claimed copyright infringement under 17 U.S.C. § 512, and it is part of the Terms of Service and the Acceptable Use Policy.
2. Notice of Claimed Infringement
If you are a copyright owner, or authorized to act for one, and believe content stored in the Service infringes your copyright, send our designated agent a written notice with:
- your physical or electronic signature;
- identification of the copyrighted work claimed to be infringed;
- identification of the material claimed to be infringing and information reasonably sufficient for us to locate it (for example the company, document name, or link within the Service);
- your name, mailing address, telephone number, and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
- a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act for the owner.
Knowingly misrepresenting that material is infringing can make you liable for damages under 17 U.S.C. § 512(f). Because uploaded content is private to a customer, we may need to share your notice with the customer who uploaded it.

4. What We Do
When we receive a complete notice, we act expeditiously to remove or disable access to the material and notify the customer who uploaded it. Incomplete notices may not be acted on.
5. Counter-Notice
If you believe material was removed by mistake or misidentification, send our designated agent a counter-notice with: your signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; your name, address, and telephone number; and a statement that you consent to the jurisdiction of the federal court for your address (or, if outside the United States, any judicial district where we may be found) and will accept service of process from the person who sent the original notice.
We will send a copy to the complainant. Unless the complainant tells us within 10 business days that it has filed a court action, we may restore the material between 10 and 14 business days after receiving the counter-notice.
6. Repeat Infringers
In appropriate circumstances we will suspend or terminate the accounts of customers or users who are repeat infringers. We may also act on a single serious violation.
7. Other Questions
